Terms of Use
These Terms of Use (“Terms”) are an agreement between you and FindBack AI LLC (“FindBack”, “we”, “us”), a Virginia limited liability company. They apply when you use the FindBack AI mobile app, the institution portal or this website (the “Service”). By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you don’t agree, don’t use the Service.
If you use FindBack on behalf of an institution under a written agreement with us, that agreement governs the institution’s use of the Service, and these Terms apply to you as an individual user to the extent the agreement doesn’t cover something.
1. What FindBack does, and doesn’t do
FindBack helps people and institutions report lost and found items, suggests possible matches, and provides tools to claim an item, prove ownership and arrange its return.
- We don’t hold items. Items stay with the finder or the institution that has them.
- We don’t decide who owns an item. Matches are suggestions. The finder or the institution’s staff decide whether to return an item, based on the evidence and their own judgement, policies and the law.
- We don’t ship items or arrange delivery. Items are collected in person, unless an institution offers another option under its own terms.
- We don’t guarantee that a lost item will be found, matched or returned.
2. Who can use FindBack
You must be at least 18 years old and able to form a binding contract to create an account. A parent or guardian may report an item lost by a child. You may not use the Service if we have previously removed you from it, or if the law prohibits you from using it.
3. Your account
- Give accurate information and keep your email address up to date; we use it for important notices.
- Keep your password and devices secure, and don’t share your account. You are responsible for activity on it.
- Tell us at support@findbackai.com if you think someone else has used your account.
- You can delete your account at any time; see Delete your account.
4. Rules for using FindBack
You agree not to:
- claim an item you don’t own, or help someone else do so;
- post a report you know is false, or keep an item you found while telling its owner you don’t have it;
- ask for payment, a gift card, a verification code or personal financial information in exchange for returning an item, or demand a reward that wasn’t offered;
- harass, threaten, impersonate or deceive anyone, including by pretending to be an institution or FindBack;
- post another person’s personal information, such as an ID number, card number or home address, in a public part of a report;
- post content that is unlawful, sexually explicit, hateful or violent, or that infringes someone else’s rights;
- report or offer weapons, controlled substances or other items whose possession or transfer is illegal; hand those to the police instead;
- use the Service to advertise, sell items or collect data about users;
- scrape, copy or harvest the Service or its data, or access it by automated means other than the interfaces we provide;
- probe, overload or interfere with the Service or its security, except under our security disclosure guidelines; or
- break any law, including laws about found property.
5. Claims, handovers and found property
- Prove ownership honestly. Your claim evidence must be true. Making a false claim may be a crime.
- Return safely. Meet in a busy public place, or collect from the institution’s counter during its pickup hours, and bring any ID the institution asks for. Confirm the handover in the app.
- Found property law. Many places have laws on what a finder must do, for example handing valuable items to the police, and how long an institution must hold an item. You are responsible for following the laws that apply to you. Using FindBack does not make you the owner of an item you found.
- Rewards. An owner may offer a reward in a lost report. Any reward is a matter between the owner and the finder; FindBack is not a party to it and does not collect, hold or guarantee it.
- Institutions’ terms. When an institution holds your item, its own rules, such as holding periods, ID requirements and pickup hours, also apply.
6. Your content
You own the reports, photos, messages and other content you submit (“Your Content”). You give FindBack a worldwide, non-exclusive, royalty-free licence to host, store, copy, adapt (for example resize or remove photo metadata), display and share Your Content as needed to operate, secure and improve the Service, including showing the public parts of your reports to other users. This licence ends when Your Content is deleted from the Service, except for copies we must keep as described in our Privacy Policy.
You confirm that you have the right to submit Your Content and that it doesn’t break these Terms or anyone else’s rights. Don’t upload photos of other people’s faces, ID documents or bank cards.
7. Moderation and enforcement
You can block other users and report messages, reports and users in the app. We review reports and may remove content, limit features, or suspend or close accounts that break these Terms or put others at risk, with or without notice where needed to protect people. If you think we made a mistake, email support@findbackai.com and we’ll review it. We are not obliged to monitor all content, and we are not responsible for content posted by users.
8. Fees
Using FindBack to report, search for, claim and collect items is free. Institutions pay for their plans under their own agreements with us. If we ever introduce a fee for individuals, we’ll tell you clearly before you are charged, and you’ll be able to choose not to use the paid feature.
9. Our intellectual property
The Service, including its software, design, text and the FindBack AI name and logo, belongs to FindBack or its licensors. We give you a personal, non-transferable, revocable licence to use the Service under these Terms. You may not copy, modify, reverse-engineer or create derivative works from the Service except as the law expressly allows. If you send us feedback, we may use it without owing you anything.
10. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent the law allows, FindBack disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the Service will be uninterrupted or error-free, that matches will be accurate, or that other users are who they say they are or will behave honestly. You deal with other users at your own risk; FindBack is not responsible for the condition, ownership or return of any item, or for what happens when users meet.
11. Limitation of liability
To the fullest extent the law allows, FindBack and its members, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of property, profits, data or goodwill, arising out of or related to the Service or these Terms, even if we were told such damages were possible. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim arose, or US$100. Some places don’t allow these limits, so they may not all apply to you. Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnity
To the extent the law allows, you agree to indemnify FindBack against claims, losses and reasonable legal costs arising from your misuse of the Service, Your Content, or your breach of these Terms or of the law, including a false claim to an item.
13. Ending these Terms
You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms, if the law requires it, or if we stop offering the Service, and we’ll give you notice where we reasonably can. Sections 6 (licence for copies we must keep), 9 to 12, 14 and 16 survive.
14. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia and applicable US federal law, without regard to conflict-of-law rules. Before filing a claim, please contact us at support@findbackai.com so we can try to resolve it informally within 60 days. Subject to that, disputes will be resolved in the state or federal courts located in Virginia, and you and FindBack consent to their jurisdiction. If you are a consumer living outside the United States, you keep any protection given by the mandatory law of your country and may bring proceedings in your local courts.
15. App store terms
If you downloaded the app from the Apple App Store or Google Play, these Terms are between you and FindBack only, not Apple or Google, and FindBack, not Apple or Google, is responsible for the app and its content. In addition, for the iOS app:
- your licence to use the app is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in Apple’s Media Services Terms;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price paid for the app (the app is free); to the extent the law allows, Apple has no other warranty obligation for the app;
- Apple is not responsible for any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims;
- if a third party claims the app infringes its intellectual property, FindBack, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim;
- you confirm that you are not in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and are not on any US Government list of prohibited or restricted parties; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. General
- Changes. We may update these Terms. We’ll post the new version here and, for significant changes, tell you in the app or by email before they take effect. If you keep using the Service after that, the new Terms apply.
- Entire agreement. These Terms, the Privacy Policy and any terms shown for a specific feature are the whole agreement between you and FindBack about the Service.
- Severability and waiver. If part of these Terms can’t be enforced, the rest still applies. Not enforcing a right isn’t a waiver of it.
- Assignment. You may not transfer these Terms. We may transfer them in connection with a merger, acquisition or sale of assets.
- Events beyond our control. We aren’t liable for delays or failures caused by events outside our reasonable control.
